Welcome to iStay. These Terms and Conditions govern the use of the iStay (“Provider App”), which allows hotels and accommodation partners to manage listings, reservations, pricing, availability, and related services on the iStay platform.

1. Eligibility

• You are authorized to act on behalf of the hotel or accommodation business.
• Your business is legally registered where required.
• All information submitted is true, accurate, and current.

2. Provider Account

• Maintain login credentials securely.
• Restrict unauthorized access.
• Keep account and business details updated.
• Responsible for all account activity.

iStay may suspend accounts for misuse, fraud, or inaccurate information.

3. Property Listings

You agree that all property information including hotel name, address, photos, amenities, room descriptions, pricing, and availability must be accurate and lawful.

iStay may remove or edit listings that violate platform standards.

4. Reservations and Booking Management

• Honor confirmed bookings except in exceptional circumstances.
• Timely reservation acceptance and management.
• Maintain accurate room inventory.
• Support guest check-in.
• Provide booked room type or equivalent where required.

Repeated cancellations may lead to penalties or suspension.

5. Pricing and Fees

You agree to maintain accurate rates and disclose taxes, service charges, and fees. iStay may charge commissions, subscription fees, promotional fees, or other agreed charges.

6. Payments and Payouts

• Guest payments may be collected by iStay or directly by Provider.
• Payouts processed according to agreed payment cycle.
• iStay may deduct commissions, refunds, chargebacks, taxes, or penalties where permitted.

7. Cancellations and Refunds

Providers must clearly define cancellation policies. If refunds are required due to provider error, overbooking, unavailable rooms, or service failure, iStay may process or recover the applicable amount.

• Business licensing
• Fire and safety requirements
• Tax obligations
• Consumer protection laws
• Health and sanitation standards

9. Guest Conduct and Property Rules

You may establish reasonable property rules, provided they are lawful, clearly disclosed, and consistently applied.

10. Reviews and Ratings

Guests may leave reviews based on their experience. iStay may moderate reviews for abuse, spam, or policy violations.

11. Intellectual Property

You grant iStay a non-exclusive right to use your property name, logo, descriptions, and images for listing, booking, and promotional purposes.

12. Confidentiality

Both parties agree to protect confidential business, customer, and operational information.

13. Limitation of Liability

• Loss of profits
• Booking interruptions
• Guest misconduct
• Indirect or consequential damages
• Events outside reasonable control

14. Suspension or Termination

• Fraudulent activity
• Repeated guest complaints
• Overbooking abuse
• Policy violations
• Legal or safety concerns

15. Changes to Terms

We may update these Terms periodically. Continued use of the Provider App after updates constitutes acceptance.

16. Governing Law

These Terms shall be governed by the applicable laws of the jurisdiction in which iStay operates.
